| Facilitation of the acquisition of rights to land. |

In 05/11/2009 the Verkhovna Rada of Ukraine adopted the Law of Ukraine "On Amendments to Certain Legislative Acts of Ukraine" (with respect to facilitating the acquisition of land rights), which simplifies the procedure for acquiring the physical and legal persons of the ownership and using land plots from the state and municipal property, and expand the rights of landowners and land users on their use. This Act makes changes to the Land Code of Ukraine, the individual articles of Laws of Ukraine "On Land Lease", "On State Land examination of documentation," “On Estimation of land”, “On land management” and provid new wording of Article 377 of the Civil Code of Ukraine “Law on Land station in case of acquisition of ownership of a dwelling house, building or structure located on it". The law provides: 1. procedure for approval of documentation for land management on a "single window" through the establishment in each district state administration or the city of regional significance to the Commission to examine issues related to the agreement of land use documentation, which should include representatives of all agencies authorized to negotiate such documentation. There is a three-week period of consideration by the commission filed documents established, as well as rules on which the grounds for refusal to agree documentation may be entirely in its incompatibility with the law; 2. expanded list of cases land plots of state and communal forms of ownership can’t be sold at auction; 3. Part 2 of Article 3, which provided the transfer of land together with buildings located on it, was excluded from the Law of Ukraine "On Land Lease"; 4. Article 7 of the Law of Ukraine "On Land Lease" was added by part 4, which states that a person has acquired ownership of the apartment building, structure or facility that are placed on leased land, also gets right to lease this land. In this connection, Article 31 of the Act was amended with the list of grounds for termination of land lease contract. Law of Ukraine dated to 05/11/2009 entered into force in 10/12/2009. |
