Representation interests of Volnogorsk mayor Print E-mail
On September 15, 2008 Industrial district court of Dnipropetrovsks’ region gave a ruling оn termination of administrative case on corruptive actions as against Vitaliy Fedorenko, Volnogorsks’ city mayor (Dniepropetrovsks’ region).

Let us recall that on August 19, 2008 Deputy Chief of Organized Crime Control Dept, Dnipropetrovsk drew up administrative offence report stipulated in Paragraph «g», Part 3, Article 5 of Anti-corruption Law of Ukraine as against Vitaliy Fedorenko stating that he as Volnogorsk city mayor had granted wrongful preferences to Y.Usenko, Deputy city mayor on social and humanitarian issues. Employees of Organized Crime Control Dept, Dniepropetrovsk drew a conclusion that violation of law was as follows: Ye.N.Usenko was appointed to a position that was crossed out from manning table which is approved by Session of Volnogorsk municipal council dated 27.03.2008. 

 
The city mayor’s interests at court were represented by Dynasty law firm, in the person of one of leading experts - Vyacheslav Kohlyakov whose prime considerations were as follows. First and foremost, resolution adopted by Session of Volnogorsks’ municipal council dated 27.03.2008 read that it was position titled Deputy city mayor on executive work associated with social and humanitarian issues that was crossed out from manning table and not the position titled Deputy City Mayor on social and humanitarian issues. Secondly Y. Usenko was reinstated in her former office immediately by Decision of Volnogorsks’ town court dated 11.06.2008. Pursuant to Article 124 of the Constitution of Ukraine a court decision that became effective shall be immediately enforced all over Ukrainian territory.

As a result, the court established that no corpus delicti was defined as against V. Fedorenko with regard to corruption, as stipulated in Item «g», Part 3, Article 5 o of Anti-corruption Law of Ukraine. Decision №3-12442/8 adopted by Industrial district court of Dniepropetrovsk dated September 15, 2008 is final and binding.
